Privacy Policy

Effective date: May 28, 2026. This Privacy Policy explains how ICAN FILM INC. ("Lucy TV", "we", "us", or "our") collects, uses, shares, and protects information when you use the Lucy TV website at lucytv.ca and our mobile and connected-TV applications (together, the "Service"). Lucy TV is operated from Calgary, Alberta, Canada, and is subject to the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian and international privacy laws.

1. Information We Collect

1.1 Information you give us directly

Account information: your name, email address, phone number, password (stored only as a one-way hash), and an optional profile photo or avatar.
Payment information: when you subscribe to our premium tier, we collect billing details necessary to process your payment. Card numbers are handled by our payment processor (Stripe, Inc.) and are never stored on our servers.
Profile preferences: the profiles you create within your account, their names, ages or birth years (used for kids-mode filtering), and parental PIN if you set one.
Support communications: the contents of any message you send through the in-app contact form, email, or other support channels.

1.2 Information we collect automatically

Viewing activity: what titles you watch, how long, where you pause or stop, what you add to your watchlist, what you rate or like. We use this to power resume-watching, recommendations, and aggregate viewership reporting to our content partners.
Device information: the type of device, operating system, browser, screen resolution, IP address, and an opaque device identifier we use to enforce device limits per account.
Approximate location: derived from your IP address. Used to determine regional content licensing, currency for billing, and compliance with regional regulations. We do not collect precise GPS location.
Cookies and similar technologies: we use a small number of cookies and equivalent storage (localStorage, sessionStorage) for session management, profile selection, and video player preferences. See section 4 for our advertising cookies disclosure.

2. How We Use Your Information

To provide the streaming service: authenticate you, remember your preferences, resume playback where you left off, deliver content licensed for your region.
To process payments and manage your subscription.
To recommend content you might enjoy based on what you and similar viewers have watched.
To send you essential service communications (account changes, payment receipts, subscription renewals, security alerts). We do not send marketing emails without your explicit opt-in.
To detect, investigate, and prevent fraudulent activity, account takeovers, and abuse of our service.
To improve our product through aggregated, anonymized analytics on usage patterns and performance.
To meet our legal and regulatory obligations under Canadian and international law.

3. How We Share Your Information

We do not sell your personal information to data brokers. We share limited information with the following categories of service providers strictly to operate the service:

Payment processors: Stripe, Inc. (for card billing in CAD/USD) and Chapa (for billing in select regional currencies).
Authentication and push notifications: Google Firebase (Authentication, Cloud Messaging).
Content delivery: Bunny CDN for video and image delivery. They process your IP address and device user- agent to route content geographically.
Email delivery: Google Workspace (Gmail SMTP) for transactional messages.
Hosting: Hetzner Online GmbH (data centres in Nuremberg, Germany) hosts our application servers and databases.
Advertising partners: on our ad-supported tier we work with Google Ad Manager, Google AdSense, and authorised programmatic demand partners (see section 4).
Legal disclosures: we may disclose information when required by a valid court order, subpoena, or other binding legal process.

4. Advertising and Cookies

If you watch on our ad-supported tier, Lucy TV serves video advertisements before, during, or after your selected content. Our advertising stack is built on Google Ad Manager and includes Google AdSense backfill demand. When an ad slot opens:

Your browser or app sends a standard advertising request to Google's ad servers containing technical signals such as your IP address, device type, approximate location, and the content you are about to watch.
Google's systems match the request to an advertiser and return an ad creative (a video or image), which then plays in the Lucy TV player.
Google sets standard advertising cookies through their domain (doubleclick.net, googlesyndication.com) used for frequency capping, audience measurement, and personalized advertising.
Where required by law (European Economic Area, United Kingdom, Switzerland, and certain US states), we present a consent banner before non-essential advertising cookies are set, powered by Google's certified Consent Management Platform.

You can opt out of personalized advertising at any time by visiting https://www.google.com/settings/ads or through your browser's Do Not Track settings. Opting out does not stop ads from showing — it changes them from personalized to non-personalized.

Lucy TV does not maintain a proprietary advertising profile of you. We do not share your name, email, payment information, or viewing history with advertising partners; the only signals sent are the technical signals listed above.

5. Children's Privacy

Lucy TV is not intended for children under 13. We do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has provided information to us, please contact us and we will delete it. Account holders are responsible for activity in any Kids profiles created within their account; the Kids profile mode filters content visibility but does not constitute consent under children's privacy regulations.

6. Data Retention

We retain personal information for as long as your account is active and as needed to provide the service. If you close your account, we will delete or anonymize your personal information within 90 days, except where we are required to retain it for legal, tax, fraud-prevention, or accounting purposes (typically up to seven years for billing records).

7. Your Rights

Subject to applicable law, you have the right to:

Access the personal information we hold about you.
Request correction of inaccurate information.
Request deletion of your account and associated data.
Request a portable copy of your information.
Object to or restrict certain processing.
Withdraw any consent you have previously given.
Lodge a complaint with the Office of the Privacy Commissioner of Canada (priv.gc.ca) or your local data protection authority.

8. International Transfers

Lucy TV is operated from Canada and our application infrastructure is hosted in Germany. By using the service, you consent to your personal information being processed in these jurisdictions, which may have different privacy laws than your home country. We apply industry-standard safeguards (TLS encryption in transit, encryption at rest, role-based access controls, and audit logging) to all international transfers.

9. Security

We use commercially reasonable physical, technical, and administrative safeguards to protect your information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Effective date" at the top and, for material changes, notify you by email or through an in-app notification at least 30 days before the change takes effect.
