Terms of Use

Effective date: May 28, 2026. These Terms of Use ("Terms") form a binding agreement between you and ICAN FILM INC. ("Lucy TV", "we", "us", or "our"), a Canadian corporation with its registered office at 5920 Macleod Trail SW, Calgary, Alberta T2H 0K2. By accessing or using the Lucy TV website at lucytv.ca, our mobile applications, our connected-TV applications, or any related service (together, the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to create an account and at least the age of majority in your province, state, or country to enter into a paid subscription. By using the Service you represent and warrant that you meet these age requirements and that you have the legal capacity to enter into a binding agreement.

2. Account Registration

To access most features you must create an account using a valid email address or supported third-party sign-in (such as Google Sign-In). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access at info@icanfilm.com.

You agree to provide accurate, current, and complete information during registration and to keep that information updated. You may not register an account on behalf of another person without their explicit consent.

3. The Service

Lucy TV offers on-demand streaming of films, television series, live channels, and original programming, as well as related features such as multi-profile household accounts, parental controls, recommendations, downloads on supported mobile apps, and casting to connected-TV devices. The available catalogue, features, pricing, and supported devices may change from time to time at our discretion.

4. Subscriptions, Billing, and Free Tier

4.1 Free ad-supported tier

A portion of the catalogue is available without a paid subscription, supported by video advertising served via Google Ad Manager. Use of the free tier is subject to the same Terms as the premium tier, with the exception that you do not pay a subscription fee.

4.2 Paid subscriptions

Paid subscriptions are offered on a recurring billing basis (monthly or annually). When you start a paid subscription you authorize us, or our payment processor, to charge your selected payment method the subscription fee plus any applicable taxes at the start of each billing cycle until you cancel.

4.3 Auto-renewal

Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. The renewal will be charged at the then-current rate for your plan. We will provide reasonable advance notice of any price increase.

4.4 Cancellation

You may cancel your subscription at any time from Settings > Subscription. Cancellation takes effect at the end of the current paid period; you will retain access until that date and will not be charged again. We do not require you to call, email, or speak with a representative to cancel.

4.5 Refunds

Subscription charges are non-refundable except where required by applicable law (such as a cooling-off period mandated in your jurisdiction). If you believe a charge was made in error, contact us within 14 days and we will review.

4.6 Gift codes and promotional credits

Gift codes and promotional credits issued by Lucy TV are subject to the terms displayed at the time of issuance. Codes are non- transferable, cannot be exchanged for cash, and may have an expiry date.

5. Intellectual Property

All content available on the Service — including films, series, live channels, original programming, posters, trailers, logos, and the Lucy TV name and design — is the property of ICAN FILM INC. or our licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the content for personal, non-commercial use only.

You may not download (except via our official offline-download feature in the mobile apps), copy, reproduce, distribute, publicly perform, modify, create derivative works of, decompile, reverse engineer, or otherwise exploit any part of the Service or its content without our prior written consent.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable local, provincial, national, or international law.
• Circumvent or attempt to circumvent any access control, digital rights management, or geographic restriction.
• Share your account credentials outside your household.
• Use automated tools, bots, scrapers, or unauthorised API clients to access the Service.
• Upload viruses, malware, or any content that would interfere with the operation of the Service or any user's use of it.
• Engage in fraud, including chargeback fraud, payment-method theft, or impersonation.
• Resell, sublicense, or commercially exploit any access you receive through the Service.

Violation of any of the above may result in suspension or termination of your account without refund.

7. User-Submitted Content

The Service does not currently accept user-uploaded video or audio content. Any feedback, suggestions, ideas, or other content you voluntarily submit (for example, through the contact form) may be used by us without obligation to you. We will not publicly attribute your submissions without your consent.

8. Termination

We may suspend or terminate your account at any time, with or without notice, for any breach of these Terms or for any conduct we determine in our reasonable judgement to be harmful to the Service, our users, our content partners, or our advertisers. Termination does not entitle you to a refund of any subscription fees previously paid.

You may close your account at any time by sending a request from the email address on your account to info@icanfilm.com. Closure is irreversible.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ICAN FILM INC., ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY CANADIAN DOLLARS (CAD $50).

11. Indemnification

You agree to defend, indemnify, and hold harmless ICAN FILM INC. from any third-party claim, loss, damage, cost, or expense (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any legal action arising out of or related to these Terms or the Service will be brought exclusively in the courts of the Province of Alberta, located in Calgary, and you submit to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. The "Effective date" at the top will be updated whenever we make a change. For material changes, we will notify you by email or in-app notification at least 30 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lucy TV concerning the Service.
